Approach the SAPS and open a case against the defaulting party in the event that you have a valid court order that outlines visitation with the minor child/ren.
Approach a legal representative and obtain advice on the process and fees related to your matter. Consideration must also be has for Rule 43/58 interim maintenance applications that may escalate legal costs. The court may award costs for legal fees where a party is not employed. A person should not be deterred from applying for interim maintenance due to lack of finances for litigation as the courts have consideration for same. and in the interest of the minor child/ren's care and protection.
Engage the services of a qualified mediator to establish if the possibility exist to resolve the dispute. As an example - Intended divorces can be resolved with the services of a mediator and possible settlement without engaging in prolonged costly litigation.
A Childens's Court needs to be approached. The minor child must also be in need of care and protection. A Children's Court can have a child removed from the circumstances that is adverse for the minor childs's well being. A High Court (as upper guardian of minor children) can also be approached. It is rather submitted that the first court to approach is preferably the Children's Court. A Childen's Court can be approached on an urgent basis for protection of minor children.
